Leasing Policy Resolution Effective May 15

At the Board meeting held on April 24, 2025, the Board adopted Policy Resolution No. 25-02 Guidelines and Procedures for Leasing Units. This resolution has an effective date of May 15, 2025 for any and all leases signed or adopted after this effective date.

We previously outlined the policy and the changes the Board considered after receiving feedback on the policy resolution from owners. The Board implemented several changes to the policy that were highlighted in the April 24 Board meeting package and prior notices which include:
- Vehicle Information: The requirement for landlords to collect and provide tenant's vehicle information to the Association has been removed.
- Timeframe: The timeframe for landlords to provide updates to the Association on new and amended leases has been changed from 10 days to 30 days.
- Existing Leases: Leases that are currently in place are "grandfathered" in and exempt from requirements to submit leasing addendums until that lease expires or a new lease is put in place. Please note that, even if a lease is renewed with an existing tenant that landlords will be required to submit the lease addendum requirements outlined in this policy resolution.
- Compliance: Clarification has been outlined in the policy resolution that enforcement procedures for noncompliance will be followed utilizing the Association's Due Process Policy Resolution and procedures. Another update was included to clarify that violations of the tenant will be considered violations of the unit owner.
Based on the growing popularity of Airbnb and other hoteling platforms—and in response to the need to ensure that lessees in the community are aware of and comply with the provisions of our Condominium instruments—the Board worked with legal counsel to develop a Policy Resolution outlining specific guidelines and procedures for leasing units.
This newly adopted policy:
- Reaffirms existing leasing restrictions, including:
- No transient or hotel-like rentals (e.g., Airbnb or short-term stays).
- Minimum lease term of 6 months.
- Introduces a standardized lease addendum, ensuring all lessees acknowledge and agree to follow Fairlington Towne’s rules and regulations.
